NOW NYS supports A-3060. It is public policy of New York State that husbands
and wives not disinherit their surviving spouses. Protection of surviving spouses
required that the waiver of the right of election should be enforceable only
when their has been the opportunity for the surviving spouse to have had fair
and reasonable disclosure of the decedent's finances including income, assets
and financial obligations.
